These Terms of Service govern your access to and use of AI SMM Assistant at socialmediauploadhelper.com. By using the Service you accept these Terms.
1. Eligibility and accounts
You must be able to form legally binding contracts to use the Service. You are responsible for your account credentials and all activity that occurs under your account.
2. Service description
AI SMM Assistant provides tools for uploading media and generating metadata, captions, hashtags and recommendations for social networks using AI models and related tooling. Features, limits and pricing may change.
3. Acceptable use
- Use the Service lawfully and in accordance with platform rules.
- Do not upload content that is illegal, infringing, abusive, or harmful.
- Do not attempt to reverse-engineer, overload, scrape or otherwise abuse the Service.
- Comply with third-party platform policies when publishing generated content.
4. AI output disclaimer
AI-generated outputs are provided "as is" and may be inaccurate, incomplete or inappropriate for your context. You are solely responsible for reviewing and validating outputs before use or publication.
5. User content — representations and license
You retain ownership of the content you upload. By uploading, you represent and warrant that you have all necessary rights to the content and that its use does not violate any laws or third-party rights. You grant us a non-exclusive, worldwide, royalty-free license to store, process, reproduce and display your content to provide and improve the Service, including training and improving machine-learning models and related quality systems, and to share the content with trusted third-party processors as necessary.
6. Subscriptions and payments
Paid features are available under subscriptions or one-off purchases. Payments are processed by Lemon Squeezy (https://www.lemonsqueezy.com), which acts as the merchant of record. We do not store payment card details. Refund and billing disputes are handled by Lemon Squeezy under their policies. Our refund rule is: if paid-plan services were used at least once, the purchase is non-refundable, except where mandatory law provides otherwise. To cancel recurring billing follow instructions provided by Lemon Squeezy or contact our support and we will assist.
7. Usage limits and free trials
The free trial is not limited by calendar end date, but it includes a monthly usage cap of 10 minutes of analysis. For trial usage, the maximum upload size is 100 MB per file. We may enforce these limits automatically; if you exceed your quota, additional usage may be blocked until the next period or until upgrade.
8. Suspension and termination
We may suspend or terminate accounts for violations of these Terms, for illegal activity, or if continued access creates security or operational risk. On termination certain provisions (e.g., liability, indemnity, IP) survive.
9. Warranty disclaimer
The Service is provided on an "as is" and "as available" basis without warranties of any kind to the fullest extent permitted by law.
10. Limitation of liability
To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential or punitive damages, including loss of profits, data or business. Specifically, we are not responsible for any actions taken by social networks (including shadowbans, account restrictions or removals) that may result from publishing content generated using the Service. Our aggregate monetary liability is limited to the amount you paid to us in the 12 months preceding the claim. Nothing in these Terms limits mandatory consumer rights under applicable law.
11. Indemnification
You agree to indemnify and hold us harmless from any claims, damages or liabilities arising from your content, your use of the Service, or your breach of these Terms.
12. Governing law and disputes
These Terms are governed by the laws of the Republic of Kazakhstan. Disputes will be resolved in the courts of the Republic of Kazakhstan, unless mandatory local consumer protection laws provide otherwise.
13. Changes to Terms
We may update these Terms from time to time. We will post the updated Terms and update the "Last updated" date. Continued use after changes constitutes acceptance.

15. Legal requests and notice procedures
You can submit data rights requests, takedown/IP complaints and invoice requests via /legal/requests or by email to [email protected]. We process verified requests in the order received and typically respond within up to 30 calendar days unless mandatory law requires another timeline.
16. Security incidents and notifications
If a security or personal-data incident occurs, we take commercially reasonable steps to contain impact, investigate root cause, and issue notifications to affected users and competent authorities where required by law.
17. Processor documentation and DPA
The Service uses third-party processors for infrastructure, authentication, AI processing and billing. We maintain processor records and implement contractual data-protection commitments. DPA-related information may be provided upon reasonable written request.
